SRA ramps up investigations into "No win, No Fee" Agreements

As reported by the Law Gazette, the Solicitors Regulation Authority has "cranked up the pressure on high-volume claims firms", over fears that clients are being "treated unfairly". This followed, the Justice Ministers recent push for regulators to take action over the behavior of law firms.

The regulator has become concerned that solicitors lack transparency when entering into contracts with their clients. A mere 12 of 25 firms contacted by the SRA were found to have provided enough costs information to their clients. The Gazette notes that "In some cases, firms failed to provide any information on fees".

Law firms have been seen as "unrealistic" when evaluating the prospects of success and did not take steps to make sure that claims management companies have met regulatory expectations when referring clients. It appears that some solicitors have acted to secure their own interests before those of their clients.
